HOLY freaking crap! bad decision to stay where we were but every body got ashore without any major injury's. Audrey treated and released for chest pains and irregular heartbeat knee still size of a grapefruit and bumps and bruises, Tommy treated and released for hypothermia. It's been said they've never seen the Indian river so rough.
we lost the bow of the dinghy and it exploded to bits against the rocks. stupidly thinking it would be safer to climb the ladder (seen in foreground) on dock then try to go over the rocks when the Starboard anchor started to go we waited for a lull then abandoned ship. by the time we got in it was blowing 50+ again. Stephen was cool until bubba lost his jacket and then we heared mom screaming, she was hanging on to the line hanging from back of boat and getting knocked about rather badly. all she had to do was let go and float, the line had 150' attached to life float 20' from the dock!
I'll list damages fully in further post but quick one,
dinghy and motor,
laptop dripping wet,
pieces of T/V scattered all over cabin,
Solar panels went sailing,
Mizzen boom gooseneck looks like a broken arm.
looks like a foot or so of water above soles.

haven't tried generator yet but cant believed it stayed on cabin top the whole time!
And yes, i did go to a real church to give thanks.

I'll be seting up a fund for begging donations but till then

Hi,

I tossed my letricsan in key west and saw a bunch on the dock as they arent legal in the keys.(no discharge)

I sailed up to melbourne and there is one freaking pump out place that charges 20 bucks! and me with a 9 gl tank :(

Please if you have one laying about or see one by the dumpster. Please i need it!!

PS i left mine siting on dock at Old Island.

On the other issue, The "numorus" complaints have been linked to the same bunch that have been stealing the bikes! three times i have had bike stolen from Eua Gallie Libary, dingy atempted theft/sunk(?) twice by this bunch! found bikes the last two times and recoverd from Willam Romer @ 1916 avacado! went by this A.M. and say mine by house this time i called police, guess wich cop showed up?

If you guesed the same cop that let the Kid caught red handed trying to steal/sink dinghy go,, you win a free lock!

called police and guess who finally shows up? you guessed it my favorite melbourne officer!
needless to say he couldnt find the report, didnt want to go there and when he did said i had no proff it was my bike because audrey didnt describe it in police report. wait a sec i thought he told me there was no report? Huh, how about that, comuunity officer found it.

Question today, has any one actually gotten a ticket for improperly secured overboard waste discharge valve? What agency gave it to you and what was the cost of the ticket. Any extenuating circumstances?

I.E. I got a ticket by FWC, it was for $250.00 the valve was, I admit, poorly secured with a electric “Zip-Tie”.

The bike pirates have struck again!
the adult at 1619 avocado Melbourne FL 32935. is using kids to run a stolen bike ring in Eua Gallie FL.
Three times we have had our bikes swiped! each time from Eua Gallie Public library, twice we have recovered them from same guy! we've told police but we don't count apparently? he has told her each time a story about buying them from a fourteen year old redhead id. i don't believe there is one living there. There is however a 17 yr or so kid living there or at least keeping his bike there that has the same shade red paint that was used on mine last time.
I do not Know his name yet But,, he has short brown hair, a jailhouse/cheap tatoo on his back shoulder that says " ROAMER" and I've seen him hanging out on the dock smoking dope more than once.
Now the tatto just tells me what kind of person this is. i doubt any M/C would have him so he aint no roamer and he's too young to have spent any state time.

We really are fighting for the right to live onboard with our kids in Melbourne FL (US). We’ve had the Children and families try to tell us it was illegal to even have kids sleep overnight on a boat!
We are currently under attack by one particularly discriminatory marine unit officer who says” I didn’t change the law” this guy also has told me “I’ll continually bother you, you WILL move “
I had my dinghy purposely sunk after an attempted theft. Culprit was caught red handed and photo taken.
Why was he let go? He told officer “I only wanted to see what was inside” .now C’mon if I break the hood open on your car because I only wanted to see what was in it would I be let go?

So what is the difference between a t-storm and a squall??
Last night we had (est) 50+ for twenty or more minutes with waves coming over dock and bow dipped once. man i don't want to be here in a storm!
No damage but i sliced my toe really bad.

At 350 PM EDT... the public reported a severe thunderstorm capable of
producing quarter size hail... and damaging winds in excess of 60 mph.
This storm was located 6 miles west of space coast stadium... or 7
miles south of lone cabbage Fish Camp... moving south at 10 to 15 mph.

What is a live-aboard vessel?
The definition of “live-aboard vessel” has been changed, effective 7/1/09. Active cruisers who live on their boats
with no permanent residence on land are no longer considered live-aboards and, therefore, their anchoring
cannot be regulated by local governments. It is no longer relevant that the vessel is a boater’s “legal residence”;
that term has been removed from the statute.

327.02 Definitions of terms used in this chapter and in chapter 328.—As used in this chapter and in chapter 328,
unless the context clearly requires a different meaning, the term:
(17)“Live-aboard vessel” means:
a) Any vessel used solely as a residence and not for navigation;
b) Any vessel represented as a place of business, or a professional or other commercial enterprise; or
c) Any vessel for which a declaration of domicile has been filed pursuant to s. 222.17.
Can my anchoring be restricted by local governments?
Under state law, boaters who use their boats for navigation (even if only occasionally) will not have their anchoring
restricted by a local city or county outside of permitted mooring fields. Cities and counties will be expressly forbidden
to “enact, continue in effect, or enforce any ordinance or local regulation … regulating the anchoring
of vessels other than live-aboard vessels outside the marked boundaries of mooring fields.”
Although local governments are allowed to regulate anchoring within the marked boundaries of properly permitted
mooring fields, there are currently a few such locations. These are Key West Mooring Field (149 moorings);
Ft. Myers Beach Mooring Field (70 moorings); Fernandina Beach Municipal Mooring Field (20 moorings);
Miami — Dinner Key Mooring Field (still under construction).
(Existing FL law) 327.60 Local regulations; limitations —
(2) Nothing contained in the provisions of this section shall be construed to prohibit local governmental authorities from
the enactment or enforcement of regulations which prohibit or restrict the mooring or anchoring of floating structures or
live-aboard vessels within their jurisdictions or of any vessels within the marked boundaries of mooring fields permitted as
provided in s. 327.40. However, local governmental authorities are prohibited from regulating the anchoring outside of
such mooring fields of non-live-aboard vessels in navigation.
(Effective 10/1/09) (from Chapter 2009-86, section 14)
(3) However, local governmental authorities are prohibited from regulating the anchoring outside of such mooring fields
of vessels other than live-aboard vessels as defined in s. 327.02.
What about the new mooring field pilot studies?
Over the next few years, the state will work in 5 geographic areas (two each on the Atlantic Coast and Gulf Coasts,
and one in the Keys) to test new anchoring and mooring concepts with both live-aboard and non-live-aboard
boats. They want to promote more mooring fields and public access to Florida waters, and to deter improperly
stored boats. Cities or counties in this program may regulate by ordinance the anchoring of all vessels outside of a
mooring field. However, this ordinance may only take effect after significant input from stakeholders and approval
from the state FWC. Any ordinances passed and the pilot program itself expire on 7/1/14.
The pilot program will be fully implemented over the next two years. No city or county has been accepted into
the pilot program – the application period has not even opened yet. It will take several months before the first
location for this program is selected and more time after that for an ordinance to be developed and approved.
As these locations are chosen, we encourage local boaters and boating groups to join the public stakeholder process
and help the cities or counties develop reasonable programs for locals and transient boaters. As of now, there
are NO enforceable anchoring ordinances outside the marked boundaries of mooring fields anywhere in Florida.

Section 48. The Fish and Wildlife Conservation Commission, in consultation with the Department of Environmental
Protection, is directed to establish a pilot program to explore potential options for regulating the anchoring or mooring
of non-live-aboard vessels outside the marked boundaries of public mooring fields….
What about boating restricted areas?
As of 10/1/09, local governments will only be allowed to create “boating restricted areas” (including but not limited
to restriction of vessel speeds or restriction of boating traffic) for public safety reasons. They must be approved
by FWC and the USCG before they are enacted and can only be put in certain areas. Until a uniform waterway
marker is placed in the water, the area may not be enforced.
These areas may include boating restricted areas located:
• Within 500 feet of any boat ramp, hoist, marine railway, or other launching or landing facility;
• Within 500 feet of marine fuel pumps;
• Inside 300 feet of any lock structure;
• Within 300 feet of any bridge fender system or a bridge span;
• Where vessel traffic presents problems of congestion or vessel safety.

(1) Boating-restricted areas, including, but not limited to, restrictions of vessel speeds and vessel traffic, may be established
on the water of this state for any purpose necessary to protect the safety of the public if such restrictions are
necessary based on boating accidents, visibility, hazardous currents or water levels, vessel traffic congestion, or other
navigation hazards…..

Went to local Ace Hardware (Eua Gallie Ace, one block up from squidlips and city pier, great bunch of guys and mucho helpfull)yesterday eveing and purchased a $1.00 angle bracet and two ten cent screws. ground by valve to bare glass and epoxed a small block of mahogany, i still have a little left from "ye old hippe workshop" on stock isle.put bracket and zip tied handle and screwed in eye for padlock on that
Now its done accordeing to city police and i have a lock to satisfy the grouper troupers.
Went to 12:00 meeting yesterday and a laywer was listing in and would like to take the case is harresment continues.
Still havent heard from ACLU yet

Hello.
I live on a sail boat anchored on the Indian river in Eua Gallie FL. I have two children ages three and ten who are enrolled in brevard county schools.
I have been boarded and inspected for compliance and safety no less than five times in as many months with no violations found. i have had DCF called three times in the past eight months with no sanctions or charges. My ten year old son has been diagnosed with Mania, ADHD and other issues,he is currently under treatment here in Melbourne FL My wife volunteers two days a week at the Circle Club.

Yesterday ((5/07/11) six uniformed officers came to nearby dock and three officers and one young man in plain clothes who refused to identify himself or show I.D.were transported by FWC to my vessel. I was informed by Melbourne police there had been "numerous" complaints about my presence and also an anonymous complaint of indecent exposure and dumping of sewage. i was informed i could be taking to jail for my pants being to low on my hips ( I've recently lost twenty + pounds) and DCF could "get" my child who was inside for not wearing a diaper. the officer then pointed to some jerry jugs in the cockpit and told the FWC officer "theres a bomb waiting to happen". These were clearly labeled water containers( light blue and block lettered "water". I was rightly issued a $250 citation for improper securing of overboard discharge valve. this valve is located in a compartment that take moving a bunch of stuff and five minutes to access. it was semi secured with a electric "zip-tie" as previously required by Melbourne police. in three previous boardings by FWC dye tablets have been placed in toilet and sewage proven to go in holding tank.

I was informed that i will be subject to "continual trouble" by Melbourne police by officer who upon leaving told me " we will make you move on land". at this time there were apx 7 kids swimming near the dock officers came from. a police women soon came to end of dock to tell me there was a complaint of children swimming from my boat wich at the time was apx 10 yards away my child was not swimming and in fact had just returned . There often are children swimming in this area but twice last week police were called out when my child entered water.

Please, can you forward me any information about live aboard rights in Brevard county? we are considered transient/homeless by local schools and agencies. Do we have any rights at all to live like other citizens and for my children to live and play among other more fortunate citizens?

While FL law has changed for the better regarding live aboards it still does not prevent local aturoties from making there own rules and harrasing boaters untill they give up.
Witness this, we have had children and familys called three times since we have been here.

I've added a google check out button to the top of the blog so y'all can help out if you wish. all funds will go toward paying tickets, yesterdays was $250.00 and local police promise more to come. i will be takeing any charges made up by melbourne police to court.

after all that put old engine back in :( no veg oil like i had hoped . its just as much hassel as it was when i took it out! but, it was put in in spain in late eightis when boat was still seripth. so it should work if i dont overheat.

Besides it a freking sailboat right??

Got more done this past two weeks than past two years.

enigine in, autopiolt, new running lights, running rigging on mizzen and will fix stern light thats been missing for three years!

Hoisted new jib and its a fine fit with one reef point. new main finally got out of bag and gesiling forgot the battens and the slugs!

Looking for someone to help bring this piece o crap to Melbourne!
The Boat: 34 Ketch that hasn’t left the dock in almost four years. It’s been a live aboard for four people and a dog. Rigging and sails are in good shape and bottoms getting scraped. It aint no pretty yacht but I’ve worked on much worse fishing boats.

Engine is back in and almost ready to go! Amazing once wires going nowhere and previous owners four years of grease and neglect had gone how much easier it is to work around!
Done
· Replaced rear oil seal
· Replaced trans seal
· Cleaned out heat exchanger.
· Replace hoses and clamps
· Service alternator
· Service starter
· Painted eng with two coats primer and two coats ceramic paint
· New ¾ Perko sea strainer mounted Above waterline
Should be done
· \Replace exhaust manifold
· Replace exhaust hose
· Install long dipstick that’s accessible from front of engine

All fresh water lines got replace with shields marine grade hose from west marine.
All new hose clamps
hot water heater removed and scarped down and five coats paint.
Engine is completed and siting on the bench waiting for me to clean out the jeep.
enginge compartment is all preped and awaits coat of paint( i have gallon grey bilge coat and most of a gallon white)

Good Day,
I will be gladglad to see someone that doesn't expect to buy a boat for nine grand, jumps in and sail around the world the next day! For the price; grocires are not included for your year long cruise :) as stated in the post it does need some work

The three most pressing issues?
• The engine must be reinstalled: I had ordered the wrong seal (ordered complete kit 4/15) so it didn’t get done this week. The main oil seal did get replaced but I had figured on doing the transmission seal also. Overfilling of engine oil caused this problem. Otherwise engine runs. It has 165Hrs on it. I will help or arrange for a mechanic to do this for you.
• The holding tank is plumbed with PVC pipe instead of hose: While seemingly minor this could lead to a very smelly mess! The hose is 2.25 a foot it will require apx.26ft. this would be a good time to put a proper Three Way Valve for overboard discharge.
• There is no 12 volt water pump: it was rusted and was removed and never replaced. There is dockside water hook up that I use. The hot water heater needs new hose clamps but works good as does the sink and shower.

The rest is mainly cosmetics. I have been stripping old varnish a little at a time and either oiling or painting it white. The boat was repainted and refinished apx.4 years ago by previous owner who used cheapest available paint. Most needs redone.
Boat has not been hauled and scraped in at least three years.

All sails are serviceable and in good to new condition.
• Like new main and jib
• Very good Genoa
• Good Drifter and Mizzen (mizzen has cal 25 insignia sewed on otherwise would be very good)
• Spare main, jib and mizzen are in poor to repairable.
• Three or four misc sails (original?)That would make OK tarps.

Mast and Rigging
Spars are in very good shape with new Mizzen Boom: all spars have been painted white with many scratches and scraped paint.
Four rivets on Stbd main spreader plate need replaced (ratcheting 36” riveter and rivets are onboard- requires two persons there is brand new West marine professional bosuns chair)
Mizzen has been rerigged recently with stay-loc fittings: triadic needs hooked in.
Winches are all in good working order: two on mast and two in cockpit
Running rigging shows signs of age.

The boat though, can be sailed away, I’ve been using the dinghy when I need to get it in/out of the slip, since I tow it behind anyway it isn’t much trouble.
It is for sale due to wife and baby moving in. it would be great for four people as a weekender or two as liveaboard, a seven year old and a baby are a little bit much!

The 45 degree minimum temperature at Key West International Airport
broke the record for the date... which was previously 46 degrees set
on January 3rd 1898. It was the first 45 degree reading in Key West
since January 24 2003... and only the second such reading since
February of 1996. The temperature in Key West has fallen below 45
degrees on only 11 occasions since temperature records began in
1872... and on only three occasions since world War two. The last

Im still getting replies from the craigslist!Maybe i'll find some one to help me make this trip a reality yet, its not like i need any money but, for instance, last night i got back to the boat and spent two hours cleaning. then i decided to fix the cabnit door thats been bugging me. it should have killid an hour tops. three hours later im all furstrated from trying to find stuff and the cabins a clutterd nightmare.
I guess somewhere during the last decade I've lost the ability to live alone.
yeah I'm working on it, but it sucks.

I realy am trying to get some more pictures of the boat but still havent found the cable for battiers. all i have now is the main computer witch eats the battiere in 45 minitues i have to go out this afternoon and run the engine for an hour or two to charge it.

Sailing!
Finally got the boat cleaned up and took it over to Stock Island. Auds opion of the boat is much better and boo saw dolphins.
Hardly any wind so it took almost four hours but it seems like a great sailor to learn to sail on. Out of money so from now on things will be done on the cheap. Spring break is at the end of the month and I want to take them to fort jeffereson.

bilge pump got replaced today, thats about it as its test day my AM class got mostly A's
and the afternoon class got ALL A'S !! However, the night class remains.
got more info and have stil not got the number of the guy that offered 8,500
but I'll get all the previous owners junk off tomorrow. and that wil make a big difference in her looks.

Got the filter!
After Cuban Joes took a look at it and gave up I took it to nappa and the kid looked at it and got it on the first try. It’s a NAPPA # 1334 (we leet- 3^1)
For once I was glad someone’s boss was there .I got to tell him how impressed I was with the service.
Did Shih’s taxes in am went over and degreased engine compartment all kind of work can be seen now. Under battery hatch is a refrigeration unit!
Got filter pliers from home depot really made getting the filter off a lot easer . Audrey came down after we saw Dr. Tony at noon and we got All the cushions in her van.

She needs new rigging on the mizzen, anyone with valid advice or help is welcome to e-mail me. As I just bought this I have very few pictures. The ones I have all show the present owners clutter.
This week’s project is to remove and wash the cushion covers. They are in good shape but dusty, Jim has lived in the aft cabin the whole time so they are relatively clean.
The stove on the other hand, really shows neglect! I think a good scrubbing with navel jelly is in order.After the cabin has been cleaned, the engine will get washed.It is in great shape, fires right up with no smoke and passes plenty of water.Here are some before pictures
